How we handle your information.

How we collect, use, share and protect your personal data, and the rights you have over it. Please read it alongside our terms and conditions.

Who we are

1.1NexStone Property Group Limited, is the controller of the personal data described in this policy, for the purposes of UK GDPR and the Data Protection Act 2018.

1.2Our regulatory status: NexStone Property Group Limited is not authorised or regulated by the Financial Conduct Authority (FCA). This website, our events and any related communications are provided for general information only and do not constitute financial, legal or tax advice, a personal recommendation, or a financial promotion regulated by the FCA. Any specific investment opportunity is only ever discussed individually, once we are satisfied we may lawfully do so.

Information we collect

2.1Information you give us directly, such as when you contact us, register your interest, join our investor community list, book a place at an event, or take steps towards investing. This may include your name, contact details, and any message or question you send us.

2.2Information we collect if you proceed towards investing, which is more sensitive and is only collected once you are in direct, individual contact with us, not through general website browsing. This may include identity documents, proof of address, source-of-funds information, bank details, and the investor declaration described in our investor documentation. We collect this to meet our anti-money laundering obligations and to assess, under the relevant financial promotion rules, whether we may lawfully share investment information with you.

2.3Information we collect automatically, such as technical data about your visit (for example, your device type, browser and pages viewed), collected through cookies and similar technology as described in Section 7.

2.4Information from calls: to maintain service standards, we may record and monitor calls where we have told you in advance that we are doing so.

2.5We do not collect any special category data (such as health, religion or ethnicity) through this website, and ask that you do not include such information in any message to us unless we have specifically requested it and explained why.

How we use it

3.1To respond to your enquiry and, where relevant, assess a property you have introduced; to keep an internal record of enquiries and submissions so that we can follow up properly; to protect this website and our team from spam and misuse; and to meet legal and regulatory obligations where they apply.

3.2We rely on your consent when you submit a form, and on our legitimate interests in running a property business and responding to enquiries. Where a relationship progresses, processing may become necessary to enter into and perform a contract with you, or to meet a legal obligation.

Who we share it with

4.1We may share your information with: professional advisers acting for us, including solicitors, accountants and compliance consultants; identity verification and anti-money laundering checking services; IT and website hosting providers who process data on our behalf, under contract; and regulators, law enforcement or other authorities, where we are required to by law.

4.2We do not sell your personal data, and we do not share it with third parties for their own direct marketing purposes.

4.3Where we use a third-party service provider, we only disclose the personal data necessary for them to perform their service, and we require them to keep it secure and use it only for the purposes we specify, under a written data processing agreement.

How long we keep it

5.1We keep general enquiry and marketing-list information for as long as you remain subscribed, or for 24 months after your last contact with us, whichever is sooner, after which we delete or anonymise it.

5.2Where you proceed towards or make an investment, we are required to keep identity, source-of-funds and transaction records for at least 5 years after the relationship ends, in line with anti-money laundering law, and we keep signed agreements for as long as needed to manage the investment and to meet our legal and tax obligations.

Accessing and updating your information

6.1You are entitled to see the information we hold about you and to ask us to correct it if it is inaccurate or out of date. To do this, please contact us using our contact form or the details in Section 11.

6.2You may opt out of receiving marketing information from us at any time, by cancelling your registration using the unsubscribe link in any email, or by emailing your request to info@nexstone.co.uk.
